Board of Adjustment
Overview
When adherence to the strict letter of the Zoning Code creates significant practical difficulties or unnecessary hardships in the construction or alteration of buildings or structures, signage or the use of land, the Board of Adjustment may vary or modify the zoning regulations creating the hardships. In all cases, the spirit of the Zoning Code will be observed, public safety and welfare secured and substantial justice done.
The Board of Adjustment can also hear appeals where it is alleged there is an error in any order, requirement, decision or determination made in the enforcement or interpretation of the Zoning Code. The Board is governed by Section 405.1040 of the Zoning Code.
There are specific application requirements for a variance and the Board can grant a variance only under very limited circumstances. In addition, all variance applications are heard in a public hearing and no particular outcome can be guaranteed. These requirements can be reviewed under Section 405.1110 of the Zoning Code, but anyone wishing to pursue a variance is urged to make their first call to the Planning Division at (314) 872-2501.
